Agreement
These terms govern your use of EMCHEQ's website, dashboard, API and related tools (the "Service"), operated at www.emcheq.com, app.emcheq.com and api.emcheq.com. By creating an account or using the Service, you agree to these terms. If you're using the Service on behalf of an organization, you're agreeing on its behalf and confirming you have the authority to do so.
What the Service does - and doesn't - guarantee
The Service checks whether an email address appears able to receive mail: syntax, domain existence, mail server (MX) records, disposable-provider and role-account signals, and, where the receiving mail server permits it, a mailbox-level check. No verification method can guarantee with certainty that a given address will accept a real message, because many mail servers deliberately decline to confirm this. Results reported as "Unknown" or "Probably valid" reflect a genuine limit of what can be checked, not a defect in the Service. The Service is provided to help you reduce bounces and understand mail-security posture; it does not guarantee delivery, inbox placement, sender reputation, or that any address you did not personally collect was collected with proper consent.
Accounts and API keys
You're responsible for keeping your account credentials and API keys confidential, and for all activity under your account. Tell us promptly if you believe a key or account has been compromised.
Acceptable use
You may not use the Service to: violate applicable law, including anti-spam and data-protection law in your jurisdiction; verify or process lists you don't have a lawful basis to hold; attempt to circumvent rate limits, quotas or access controls; or use the mail-security simulation features (including phishing simulations) against anyone outside your own organization or without authorization to test them. We may suspend or terminate accounts that violate this section.
Plans, billing and cancellation
The free plan and paid plans are described on our pricing page, which reflects the live, current plan data - not a separate, possibly outdated, copy of it. Paid plans are billed through our payment processor (Stripe); we don't store your full payment card details ourselves. You can cancel a paid plan at any time and return to the free plan; cancellation stops future billing but does not retroactively refund the current billing period unless we say otherwise at the time.
Your data and content
You retain ownership of the email addresses, lists and domains you submit for checking. Bulk list files are parsed in your browser before anything is sent to us; we only receive the specific addresses you confirm for checking. We use your data to provide the Service to you (running checks, showing your history, billing) and as described in our Privacy Policy - not to build or sell a separate list product from your data.
Disclaimers and limitation of liability
The Service is provided "as is," without warranties of any kind beyond what's stated above. To the maximum extent permitted by law, EMCHEQ is not liable for indirect, incidental or consequential damages arising from your use of the Service, including bounces, deliverability issues, or decisions made based on a verification result.
Changes
We may update these terms as the Service changes. Material changes will be reflected by an updated "Last updated" date on this page.
